These Terms & Conditions ("Terms") govern your access to and use of the DigiMyWay website, mobile applications and related services (together, the "Platform"), operated by Virashu Global Private Limited("DigiMyWay", "we", "us" or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. About the service
DigiMyWay is an online marketplace that connects customers who require device repair services with independent, verified repair technicians ("Technicians" or "Partners"). We facilitate discovery, live quoting, booking, payment collection and dispute resolution. Repairs are performed by independent Technicians, not by DigiMyWay itself.
2. Eligibility
- You must be at least 18 years old and legally capable of entering into binding contracts.
- You must provide accurate, current and complete information when using the Platform.
- You are responsible for maintaining the confidentiality of your account and any one-time passwords (OTPs) issued to you.
3. Accounts and authentication
Access to most features requires signing in with a mobile number verified through a one-time password. You agree to provide a valid mobile number that you control and to keep your account information accurate. You are responsible for all activity that occurs under your account.
4. Quotes, bookings and pricing
- A repair request you submit may be broadcast to verified Technicians located near you.
- Technicians respond with quotes that may specify the part grade (Original, OEM or Compatible), price, warranty and estimated turnaround.
- Prices are set by the Technicians. DigiMyWay does not determine the price of any repair.
- A booking is confirmed only when you accept a specific quote and hand over the device.
- Where a repair requires inspection before a final price can be quoted, the Technician will notify you and seek your approval for any revised price before proceeding.
5. Payments
- Payments are processed through secure third-party payment gateways. By paying, you also agree to the terms of the relevant payment service provider.
- Amounts may be held securely and released to the Technician only after you confirm that the repair has been completed to your satisfaction, in accordance with ourRefund & Cancellation Policy.
- You agree to pay all applicable charges, including any applicable taxes, for services you book through the Platform.
- DigiMyWay is not responsible for any fees charged by your bank or payment provider.
6. Technician obligations
Technicians are independent third parties and are solely responsible for the repairs they perform, the parts they supply, the warranties they issue and compliance with all applicable laws. Technicians are required to complete identity and business verification before they may quote or accept jobs. DigiMyWay does not itself perform repairs and is not a party to the repair contract between you and a Technician.
7. Cancellations and refunds
Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.
8. Warranty
Each repair may carry a warranty offered by the Technician against the specific part fitted. The warranty period and scope are stated with the relevant quote. Warranty claims are handled between you and the Technician, with DigiMyWay providing reasonable assistance through its support and dispute-resolution process.
9. Acceptable use
You agree not to:
- Use the Platform for any unlawful, fraudulent or misleading purpose.
- Post false, abusive, defamatory or infringing content.
- Attempt to interfere with, reverse-engineer or gain unauthorised access to the Platform.
- Circumvent the Platform to transact with a Technician in order to avoid applicable charges.
- Impersonate any person or misrepresent your affiliation with any entity.
10. Intellectual property
All content, trademarks, logos, software and materials on the Platform are owned by or licensed to Virashu Global Private Limited and are protected by applicable intellectual-property laws. You may not copy, reproduce, distribute or create derivative works without our prior written consent.
11. Disclaimers
The Platform is provided on an "as is" and "as available" basis. While we take reasonable steps to verify Technicians, DigiMyWay does not warrant that any Technician's work will meet your expectations, and we disclaim all warranties to the fullest extent permitted by law, except as expressly stated in these Terms or our policies.
12. Limitation of liability
To the maximum extent permitted by law, DigiMyWay shall not be liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising out of or in connection with your use of the Platform. Our aggregate liability shall not exceed the amount paid by you for the specific transaction giving rise to the claim.
13. Indemnity
You agree to indemnify and hold harmless DigiMyWay, Virashu Global Private Limited and their officers, directors, employees and agents from any claims, losses, liabilities and expenses arising from your breach of these Terms or your misuse of the Platform.
14. Third-party services
The Platform may integrate or link to third-party services, including payment gateways, messaging services and map providers. Your use of those services is subject to their own terms and privacy policies, and DigiMyWay is not responsible for their content or practices.
15. Suspension and termination
We may suspend or terminate your access to the Platform at any time if you breach these Terms or if we reasonably believe your use poses a risk to other users, Technicians or the Platform.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date, and continued use of the Platform after such changes constitutes acceptance of the revised Terms.
17. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to applicable law, the courts at Raipur, Chhattisgarh shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Platform.
